On May 20, the Ukrainian Agrarian Business Club filed an appeal against the decision of the Kyiv District Administrative Court (KLA). concerning quotas on imports of nitrogen and complex fertilizers. This was reported by the press service of the association.

It will be recalled that by decisions of March 31, 2021, in cases №№ 640/16663/20 and 640/16665/20 the court annuls the decision of the Interdepartmental Commission on International Trade (ICTM) of June 22, 2020, on the inexpediency of quotas on the fertilizer market and obliges ITC to decide on the introduction of quotas on imports of mineral fertilizers to Ukraine. Thus, OASK partially satisfied the claims of Azot PJSC and Khimvektor LLC, which are part of the Ostchem group of companies owned by Dmytro Firtash.
Participants in these lawsuits are also the Association “Ukrainian Club of Agrarian Business” (UCAB), which represents the interests of farmers as consumers of mineral fertilizers. In particular, in its appeals, UCAB emphasizes that the court ignored important circumstances and evidence in its decision, which allows it to claim its illegality. It should also be noted that the court is a law enforcement body that is not authorized to replace the state body of the ICMT, and therefore – to make decisions instead and give instructions to address issues that fall within the exclusive competence of the ICMT.
“UCAB believes that the UACC has gone beyond its discretion, indicating what decisions should be taken by the Interdepartmental Commission as a collegial body. We hope for a fair and objective consideration of the case in the appellate instance, and in any case, we are ready to defend our position in the Supreme Court as well, ”commented Roman Slastyon, Director General of UCAB.
