On July 14, the Constitutional Court of Poland refused to comply with the interim decision of the European Court of Justice in the case of the rule of law.

The Constitutional Court concluded that the European institution’s provision on Poland’s legal and judicial system did not comply with its constitution.
This is an order from 2020, in which the highest court of the European Union ordered to suspend the work of the new disciplinary chamber at the Supreme Court of Poland.
Warsaw’s reaction
According to the country’s ruling Law and Justice Party, the European Union is interfering in the internal reforms allegedly needed to increase the efficiency of the courts and eliminate the remnants of the communist past.
At the same time, critics, both within Poland and in the EU, argue that these reforms undermine the rule of law and increase the impact of the PiS on the legal system.
Justice Minister Zbigniew Zobro welcomed the Constitutional Court’s ruling, saying it was “against interference, usurpation and legal aggression by European Union bodies”.
Instead, former European Council President Donald Tusk, who heads Poland’s opposition Civic Platform party, accused the government of “leaving the EU”.
Warsaw and Brussels have been arguing for years over reforms under the PiS-controlled government.
This week, the Constitutional Court is expected to rule in another case on whether EU law takes precedence over Poland’s constitution.
The European Union filed a complaint against Poland with the Luxembourg-based European Court in March this year. On 31 March, the European Commission requested that the European Court of Justice ruling on the suspension of past decisions of the Disciplinary Chamber until the EU Court has given a final decision on the matter.
