In Ukraine, communities have been given the right to manage land within their own territory. At the same time, the procedure for making decisions on the alienation of land from community ownership has changed.

With amendments to the law “On local self-government in Ukraine”, the decision of the local council on the free transfer of land from communal to private ownership is adopted by at least two-thirds of the votes of deputies of the general council.
“This innovation does not apply to land plots that are already in use by citizens. Such a rule will make it possible to eliminate possible corruption at the local level, “said Serhiy Sharshov, head of the directorate for local self-government development at the Ministry of Regional Development.
He noted that when making decisions by local governments on the free transfer of ownership of land (from communal lands) should take into account the category of land.
Sufficient majority of council deputies in the case of:
-deciding on the free transfer of land from communal to private ownership, if such land is in the use of citizens;
– if a residential building, other building, or structure belonging to a citizen who has applied for the transfer of the land plot is located on the land plot;
-if it concerns land plots for which title documents have been previously issued.
Two-thirds of the votes of the deputies of the general composition of the council are required in case of decisions on other land plots.
