Andriy Verevsky’s Kernel company has submitted to the Swiss court a forged document on the change of the owner of Stiomi Holding.

The publication reminds that in 2012 Kernel bought Stiomi Holding and Khmelnytsky Bakery from the Stadnyk family (Mykhailo and Inessa). Verevsky agreed to buy these assets for $ 60.9 million, but then paid Stadnik only 40% of the amount, or $ 24 million.
The rest must be paid if Stiomi Holding meets certain conditions. However, the parties disagreed on the obligations of the agreement, and in December 2012 Stadniki filed a lawsuit against Kernel in the London International Court of Arbitration.
In February 2018, the court partially upheld the claim of the former owners of Stiomi Holding, ordering Kernel to pay them almost $ 33.5 million. taking into account interest and court costs. But, three years later, Kernel did not comply with the decision of the London court.
The fact is that in March 2020, in the history of Kernel’s debts, a Ukrainian businessman appeared before Stadnyky, who allegedly bought the right to claim the entire amount of Kernel Holding SA’s debt from Stadnyk’s ex-wife for UAH 1 million. According to domestic media, it is about a certain Oleg Oliynyk.
At one of his press conferences, Stadnyk stated that Oliynyk was an impostor and that he could not make any purchase of Stiomi Holding from his wife. At least because Inessa Stadnyk owned only 1% of the shares of Stiomi Holding.
Kernel appears to have forged a document to change the owner of Steomi Holding in order to delay or not pay the Stadnikov family’s “debts” at all, Swiss journalists write.
“In order to persuade the court by cunning deception to make a decision in their favor,” – said in the publication.
Stadnyk intends to prove forgery in court. He made his first attempt in December 2020, but at that time he did not have enough arguments.
A criminal case of forgery is being investigated by Ukrainian law enforcement.
We will add that Oliynyk does not have originals or duly certified copies of documents confirming the right of claim. He would have had such documents at his disposal if he had actually acquired the right of claim from the previous creditor. But he directly admitted that he did not have such documents in the first trial in Ukraine, in which he tried to recognize and enforce the arbitral award (case No. 824/222/20).
It will be recalled that Oliver Church, a representative of Mykhailo Stadnyk and other Stiomi-Holding sellers, links Oliynyk with Konstantin Likarchuk (ex-deputy head of the State Tax Service), a partner of Avellum law firm, which has been serving Kernel for a long time.
However, Likarchuk himself denies this.
