Despite high expectations from the state, TSC on investor protection is engaged only in self-publicity, instead of real work. This is the opinion of Oleksandr Okhrimenko, president of the Ukrainian Analytical Center.

“Investor protection TSC is PR in general, just PR. In the entire history of Ukraine, no TSC has ever really done anything. Along with this, it is very fashionable to talk about foreign investment. So we have what we have. And about Ukrainian – not fashionable. That is why such TSCs are created not from the point of view of common sense, but from the point of view of fashion, ”the expert believes.
At the same time, the President of the Ukrainian Union of Industrialists and Entrepreneurs Anatoliy Kinakh emphasizes the importance of the domestic investor. In his opinion, the Ukrainian government should not underestimate the importance of domestic entrepreneurs in the development of the Ukrainian economy.
“When we declare strategic goals – attracting investment or protecting business, we very often mean only foreign investment, foreign private capital. And this is wrong because the work of a national investor is crucial … In this context, it is impossible to draw a line between a foreign investor and a domestic one. This is all private capital in general, regardless of its source, ”Anatoliy Kinakh emphasized.
Meanwhile, some foreign companies use so-called “investment blackmail” to protect their interests. In particular, representatives of Scania Ukraine have repeatedly stressed the importance of this company as a foreign investor. And they appealed that the loss of the Swedish company in a lawsuit with the Ukrainian dealer “Crane” could nullify the investment of this country in our country.
This position of Scania Ukraine was actively supported by some experts.
However, in contrast, there were statements from the people’s deputies of Ukraine regarding unequal conditions for foreign and domestic investors to protect their rights by the state.
During one of the stages of the lawsuits between the domestic dealer “Cranberries” and the Swedish investor Scania Ukraine, Swedish Ambassador Tobias Tiberg even sent a letter to the chairman of the court, in which he pointed out the importance of the business climate in Ukraine. Oleh Politylo, director and owner of the Ukrainian company Zhuravlyny, spoke about this. The company has been suing Swedish distributor Scania Ukraine for almost 9 years. According to Political, this letter allegedly had an impact on the course of the case, because after the letter from the Swedish ambassador, the court hearing was postponed and the panel of judges changed.
The next court hearing between Zhuravlina and Scania Ukraine is scheduled for October 20. The case, as it turned out, is being monitored by the Temporary Special Commission for the Protection of Investors’ Rights, namely, the head of the TSC, Halyna Yanchenko. At one time, she stated in this case – they say that the Temporary Commission of Inquiry takes a neutral position. However, in her blog, she voiced only the position of a foreign investor. Currently, Halyna Yanchenko personally refuses to comment and states that TSK does not take anyone’s position, but the media already call the Scania Ukraine case: a case that really shows the work of TSK.
