Kyiv.Ukraine.Ukraine Gate – November 8,2021- The Kharkiv District Administrative Court refused to file a lawsuit on the public network OPORA regarding the number of votes in 40 polling stations in three districts of the city. The observers promised to appeal.
Thus, in the cases brought before the regional election commissions of the Novobavarskaya and Khlodnoherskaya regions, the court based its decision on the fact that the electoral law does not allow to draw up updated protocols after the announcement of the election results. However, the court acknowledged the inconsistency in the protocols.
OPORA found inconsistencies between the Kholodnohirska TEC protocol and the protocols at 30 polling stations in this area of the city. Total dispute there are 248 votes in favor of Igor Tereshkova.
On the other hand, the data for the Novobavarskaya TEC protocol do not correspond to the indicators of 9 local PECs. There, the difference was 397 votes in favor of Terekhov.
OPORA also received a rejection of the lawsuit against Osnovyanska TEC, which concerns only one polling station. According to observers, a polling station representative during the TEC meeting did not announce the data available during the post-counting counts, which resulted in Terekhov receiving an additional 70 votes.
The court motivated the decision by the fact that the data of the minutes of the TEC meeting did not differ from the data of the polling station. Instead, the court did not take into account the information of the copy of the protocol of the OPORA observer .
As it was reported, in Kharkiv on October 31 early elections of the mayor which were appointed after death of the mayor Gennady Kernes took place. On November 1, the City Territorial Election Commission voted to recognize Igor Terekhov as the winner. There will be no second round of elections.
Candidates in the Kharkiv mayoral election said that the results of the vote count were falsified, and Mykhailo Dobkin, who took second place, said he intended to challenge the results in court.
