“The Ministry of Justice of Ukraine is not considering the issue of extradition of Saakashvili,” the agency said.

So, in the ministry explain that, according to Art. 541 of the Criminal Procedure Code of Ukraine extradition of a person (extradition) is the extradition of a person to the state, the competent authorities of which this person is wanted for criminal prosecution or execution of a sentence.
According to Art. 575 of the CPC of Ukraine, a request for extradition to Ukraine is prepared by an investigator, prosecutor supervising compliance with the law during the pre-trial investigation, or a court hearing the case or sentencing, in compliance with the requirements of this Code and the relevant international treaty of Ukraine.
“Thus, the procedure of extradition of a person to Ukraine can be initiated by the competent authority of Ukraine only in the case of criminal proceedings on the territory of Ukraine against a person or a court verdict,” the Ministry of Justice explains.

Mikheil Saakashvili arrived in Georgia on September 29 and was detained in Tbilisi on October 1. He was sentenced in absentia to three and six years in prison on charges of abuse of office and misuse of office. Two more charges, including embezzlement of state funds for personal needs, are still pending in court. The fifth charge – illegal crossing of the state border – was filed on October 20. He has been on hunger strike since the day of his detention.
