By Resolution 49/1 of 4 March 2022, adopted in an “urgent debate”, the Human Rights Council decided to establish an independent international commission to investigate violations, consisting of three experts appointed by the President of the Human Rights Council. The Commission was instructed to investigate all possible violations and oppression of human rights and violations of international humanitarian law, as well as related crimes, in the context of aggression against Ukraine by the Russian Federation.
The three-member commission was also mandated to “collect, summarize and analyze evidence of such violations and harassment, including their gender dimension, and to systematically record and store all information, documents and evidence, including survey records, witness statements and forensic materials. , in accordance with the standards of international law, in the event of any future litigation. “
The commission, established for an initial term of one year, was asked to “establish the facts, circumstances and root causes of any such violations and harassment”, as well as to supplement the work of the human rights monitoring mission in Ukraine, consolidate its results and build on them. coordination with the mission and the Office of the High Commissioner for Human Rights.
The investigative body was also requested to identify, where possible, persons and entities responsible for human rights violations and related crimes committed in Ukraine in order to bring them to justice. He was instructed to make recommendations to end impunity and ensure criminal responsibility, as well as victims’ access to justice.
The Commissioners-in-Office were invited to provide the Human Rights Council with oral updates on their work at the 51st session of the Council in September 2022 and a comprehensive written report at its 52nd session in March 2023.
