She stressed that this is not the first time such tactics have been used by Russian troops.
“After bringing the city to a critical situation, the enemy offers a conditional corridor to Russia, ostensibly to save people, leaving people no choice. Currently, Russian media report that they removed 615 thousand people from Ukraine, including 121 thousand children. Such treatment of peaceful the population is a crime against humanity and a war crime as defined by the Rome Statute of the International Criminal Court, “the Ombudsman said.
Denisova stressed that the European Convention for the Protection of Human Rights and Fundamental Freedoms guarantees that no one can be expelled from the territory of the state of which he is a citizen. That Article 7 of the Rome Statute of the UN International Criminal Court qualifies “deportation or forcible transfer of population” as a crime against humanity that entails international criminal responsibility.
“I appeal to the UN Commission to Investigate Human Rights Violations during Russia’s Military Invasion of Ukraine and the expert mission set up by the OSCE participating States under the Moscow Mechanism to take into account these war crimes and human rights violations in Ukraine,” she said.
