On June 3, the Verkhovna Rada of Ukraine registered the draft law № 7433 “On Amendments to the Law of Ukraine“ On Collection and Accounting of the Single Contribution for Compulsory State Social Insurance ”and some other laws of Ukraine on protection of the rights of individuals during martial law and simplification of accounting jobs for people with disabilities, ” .
The initiator of the bill is Danylo Getmantsev, Chairman of the Verkhovna Rada Committee on Finance, Tax and Customs Policy.
The purpose of the bill
According to Hetmantsev, the purpose of the document is to improve conditions for the protection of individuals’ rights to work and social protection by ensuring timely registration of employee employment in electronic form, as well as expanding the use of information contained in the State Register of Compulsory State Social Insurance. to ensure the labor rights of workers and persons with disabilities and to simplify reporting for employers.
What is offered
- ensuring the exchange of information between the State Register of Insured and Insured Persons and the Fund for Social Protection of Persons with Disabilities, which will eliminate the need for employers to keep separate records in such Fund and submit reports in order to comply with quotas on employment of persons with disabilities.
- opportunity for persons with disabilities, in case of missing the term of medical and social examination to continue the payment of disability pension such re-examination no later than 1 month after the end or cancellation of martial law.
- ensuring martial law for children aged 18 to 23 during the period of martial law in Ukraine and for one month after its termination, the appointment of pensions in the event of loss of a breadwinner and the payment of previously assigned on the basis of data on full-time education form of education in 2022, received by the Pension Fund of Ukraine from the Unified State Electronic Database on Education.
- It is established that the appointment of pensions to internally displaced persons who do not have documents and / or for whom there is no information about periods of insurance, employment during martial law and within 180 calendar days after its termination or cancellation, is based on available information in the relevant electronic state registers.
- digitization of accounting of labor activity of employees is provided. In particular, the employer or the person himself in the absence of relevant information in the register of insured persons may submit through the web portal of electronic services of the Pension Fund of Ukraine information on moving from one unit to another or transferring to another permanent position or job, dismissal, resumption actions of the employment contract, as well as the assignment, change or deprivation of rank, rank, class, title, category, taking the oath, internship, training, etc. This approach will completely abandon paper workbooks, and will allow employees to better protect their rights, as well as simplify the need for them to confirm the relevant information in the future.
When will these changes take effect?
If the bill is adopted, it will enter into force on the day following the day of its publication, except for paragraph 1 of Section I and subparagraph 2 of paragraph 2 of Section II, which will enter into force three months after the publication of this law.
