The Ministry of Economy of Ukraine did not approve the amendments to the legislation proposed by the Minister of Infrastructure Vladyslav Krykliy in order to cancel the competition for the position of UkSATSE director.
“The Ministry of Economy really did not approve the draft resolution,” the press service said.
This is a draft resolution by which the Minister of Infrastructure Vladyslav Krykliy tried to change the Procedure for conducting a competitive selection of heads of economic entities of the public sector of the economy.
According to the changes proposed by the Ministry of Infrastructure, the requirements of the competitive selection should not have applied to the head of UkSATSE.
The Ministry of Economy explains the deviations of the changes proposed by Krykliy by the fact that UkSATSE is a state unitary enterprise, where the formation of a supervisory board is mandatory.
And it is the supervisory board that appoints and terminates the powers of the head, approves the terms of the contract with him, sets the amount of remuneration, concludes and terminates the contract with him, monitors compliance with the terms of the contract.
“In addition, on July 29, 2020, the Government supported the proposal of the Ministry of Economy to continue implementing the principles of corporate governance of the Organization for Economic Cooperation and Development in the TOP-15 largest state-owned companies, including UkSATSE.
Thus, the issue of appointing the head of UkSATSE should be decided in accordance with the Law by the supervisory board of this enterprise, taking into account the current version of paragraph 11 of the resolution of the Cabinet of Ministers of Ukraine from 03.09.2008 № 777 “, – explained the Ministry of Economy.
However, the state enterprise UkSATSE believes that the order of the Minister of Infrastructure Vladyslav Krykliy is enough to appoint the director of the state enterprise.
“Appointment of heads of enterprises subordinated to the Ministry of Infrastructure of Ukraine is made on the basis of an order of the Minister in agreement with the Government.
Accordingly, the Cabinet of Ministers of Ukraine approved the appointment of Andriy Yarmak to the position of Acting Director of UkSATSE – the relevant order was promulgated on October 9, 2019,” the press service of UkSATSE reported.
According to the People’s Deputy Sergey Bunin, Andrey Yarmak is illegally in a position of the acting for more than a year. According to the current legislation, the status of acting director is allowed to be up to three months – at the time of the competition.
In addition, according to Bunin, the competition has not been held yet, because Yarmak does not meet the requirements for the position of director of UkSATSE in terms of education and experience.
That is why, according to Bunin, the Minister of Infrastructure Krikliy tried to change the resolution of the Cabinet of Ministers so that Andriy Yarmak could be left as a director of a strategic state-owned enterprise without a competition.
