The lawsuit is being filed against Hungary over a law in effect from 2021 that prohibits access to content that the country’s authorities consider to be LGBT propaganda among minors. In particular, the Prime Minister of the country, Viktor Orban, responded to accusations of violation of EU laws and restrictions on human rights, that these laws are not discriminatory, but prohibit the “promotion” of LGBT content to children at school.
“The protection of minors is a legitimate public interest that the EU shares and strives for. However, in this case, Hungary failed to explain why children’s exposure to LGBT content could harm their well-being or not be in the best interests of the child,” the release said.
As for Poland , since 2020 the country has approved measures aimed at combating the so-called “LGBT ideology”. Similar resolutions were adopted in more than 90 cities and districts of Poland, where about a third of the country’s population lives. The authorities declared these areas “LGBT-free zones”.
Last September, the European Commission threatened the regions of Poland with the deprivation of funds from the REACT-EU fund, which are supposed to help EU states cope with the consequences of the coronavirus pandemic.
As emphasized in the statement of the European Commission, “Polish authorities failed to fully and adequately respond to her request regarding the nature and impact of the resolutions” on “LGBT-free” zones.
Poland and Hungary now have two months to respond to the arguments put forward by the European Commission.
