The Verkhovna Rada registered draft law No. 8011 on amendments and additions to some laws of Ukraine in order to ensure the rights of war participants to biological post-traumatic paternity/maternity.

“The purpose of the draft law is to create state guarantees regarding the preservation of the possibility of biological paternity/maternity for defenders of Ukraine, in case they receive injuries that affect reproductive functions,” the explanatory note says.

It is reported that the draft law proposes to make additions to the legislation, according to which during the period of martial law, in particular, military personnel have the right to participate in a set of measures implemented by the state in order to ensure the right to biological post-traumatic parenthood (maternity).
It is noted that the draft law does not provide for the introduction of state measures to ensure posthumous paternity/maternity. The procedure for the use of biological materials in the event of the death of a serviceman, according to the norms of the project, should be determined by the Cabinet of Ministers of Ukraine, taking into account the requirements of the legislation on the protection of personal information.
As Oksana Dmytrieva, a People’s Deputy from “Servant of the People”, who is a co-author of the bill, explained on her Facebook page , there was a separate discussion regarding posthumous paternity/maternity. “With this project, we do not prohibit this, and we anticipate that after the adoption of this draft law, the Cabinet of Ministers of Ukraine will prescribe the necessary procedure for voluntary consent/disagreement for the posthumous use of such cells and their possible transfer to the relevant banks,” Dmytrieva said.
Also, one of the tasks of the draft law is to extend part of the guarantees in the field of medical care and rehabilitation measures provided to military personnel to police officers who perform official duties in areas of military operations. In particular, regarding the right to participate in the complex of measures implemented by the state, with the aim of ensuring the right to biological post-traumatic parenthood (motherhood).
In addition, it is reported that according to the calculations of specialized health care institutions, the cost of sperm collection is about 450 hryvnias for men and about 1,425 hryvnias for women. Necessary medical examinations before taking cells from healthy citizens can be carried out during the general examination of the military medical commission.
