Recently the Parliament of Ukraine adopted on first reading a bill amending the Law of Ukraine “On local state administrations” and some other legislative acts of Ukraine on the reform of the territorial organization of executive power in Ukraine 4298.

- The current law on local state administrations, adopted 22 years ago, has lost its relevance in the context of decentralization and needs to be changed. That is why the Ministry of Regional Development together with MPs has developed a new bill that provides a clear division of powers in key areas, as well as issues of formation and organization of regional and district state administrations, – said Alexei Chernyshov, Minister of Community and Territorial Development.
The need to adopt this law is due to the fact that after the change of administrative-territorial structure, the state transferred most of the powers to local governments of the newly created territorial communities. And as new district state administrations are being formed in the country, the work of which will be significantly different from the work of the former RSAs, there is a need to create an appropriate legal framework.
It is assumed that local state administrations will perform three main functions:
coordinate the activities of territorial subdivisions of central executive bodies;
ensure legality in the territory;
until the relevant amendments to the Constitution of Ukraine are made, they will perform the functions of the executive body of oblast and rayon councils.
MDA heads will be given back the status of civil servants.
After the entry into force of this Law, the heads of local state administrations shall continue to exercise their powers provided by the Constitution of Ukraine, this, and other laws of Ukraine.
In the future, heads of local state administrations will be appointed by the President of Ukraine on the proposal of the Government from the personnel reserve for a term of 3 years, including in the order of transfer from another administrative-territorial unit.
It is assumed that the personnel reserve should be formed by January 1, 2022.
