Any land plot has its own boundaries that separate one territory from another. Sometimes there are situations when the owners need to set the boundaries of the land in kind (on the ground).
Most often this should be done in the following cases:
▪️ drilling of wells;
▪️ acquisition of land by a new owner;
▪️ during construction on the land plot;
▪️ in border disputes with adjacent landowners/land users;
▪️ damage or loss of previously established boundary markers.
Establishing the boundaries of the land consists of several steps:
▪️ Conclusion of an agreement with a land management company for the preparation of technical documentation for the establishment (restoration) of the boundaries of the land in kind.
▪️ To conclude an agreement with a land management organization, it is necessary to provide the following documents:
▪️ a copy of an identity document and the registration number of the taxpayer’s account card;
▪️ a copy of the document certifying the right of ownership of real estate located on this land plot (if any);
▪️ a copy of the document certifying the right of ownership (use) of the land plot (if any);
▪️ a decision of a local self-government body or an executive body on granting a permit for allotment of a land plot into ownership or use with a copy indicating its location.
Preparatory works – analysis of source materials, data of the State Land Cadastre, legal grounds for granting land ownership (use), information on the existence of controversial issues regarding the boundaries of the land plot, etc.
Topographic and geodetic works – execution of geodetic surveys on the ground to determine the turning points of the boundaries of land plots and the establishment of boundary markers.
The land surveyor shall fix the boundaries of the land plot in kind (on the ground) with boundary markers in the presence of the owners or users of the land plot, owners (users) of adjacent land plots, or persons authorized by them.
Carrying out this procedure in the absence of owners (users) of adjacent land plots in case of their non-appearance is possible only if they were duly notified of the time of the above works, as indicated in the act of acceptance-transfer of boundary markers for storage.
The disagreement of the boundaries of the land plot by the neighbors is not a ground for the decision of the local self-government bodies to refuse to approve the technical documentation for the land plot and to refuse to transfer such land plot to the applicant’s ownership.
